I. All
BEST OILTOOL Casing Scrapers shipped after January 1,
1977 are guaranteed as follows:
A. All parts are
unconditionally guaranteed as to materials,
workmanship and specifications.
B. In addition the
basic scraper mandrel is further guaranteed to the
original purchaser, for a period of one year from
shipment against ANY DOWNHOLE DAMAGE FROM ANY CAUSE
WHATSOEVER THAT RENDERS THE SCRAPER INOPERATIVE. NO
ESCAPE CLAUSES REGARDS DOWNHOLE CONDITIONS OR
CONDITIONS BEYOND OUR CONTROL ARE INCLUDED. JUST A
SIMPLE "YOU TEAR IT UP DOWNHOLE— WE WlLL
REPAIR OR REPLACE IT!! "
II. Conditions:
A. Tools and/or
parts must be returned prepaid to the Houston, Texas
plant, with a request to repair under the guarantee.
B. Tools and/or
parts will be shipped freight collect upon return.
C. D. M. Best
Company, Inc. Inspectors will be final authority on
damage and guarantee determination.
D. There will be
no Charges whatsoever (except freight) on guarantee
as to material, workmanship and specifications.
E. There will be a
handling and service fee of $25.00 for guarantees
relative to mandrels returned under 1. B above which
covers paper work, plating, painting assembly if
necessary and boxing.
F. Cosmetic damage
(Cuts, Abrasions, Tong Marks, and similar) are not
covered under the guarantee UNLESS they cause the
tool in our opinion to be inoperative, in which case
they too will be covered under I. B above.
G. The tool must
be identifiable when returned. Note each scraper
mandrel has a serial number stamped on the tool joint
pin at the large OD of the threaded end—next to
the shoulder—and also on the center ring bearing
section (the "ring" appearing area in the
center of the mandrel). DO NOT REMOVE THESE NUMBERS,
AS THEY HELP IDENTIFY THE TOOL, THE DATE, THE BUYER.
III. Liability:
A. This is the
sole warranty of D.M. BEST CO., INC. and no other
warranty is applicable, either express or implied, in
fact or by law, including any warranty as to
merchantability or fitness for a particular use or
purpose. In case of goods or parts not wholly D. M.
BEST CO., INC. manufacture, D. M. BEST CO., INC.
shall make available to the customer whatever
warranty or guaranty is extended to D. M. BEST CO.,
INC. for such goods or parts by the supplier or
manufacturer thereof.
B. D. M. BEST CO.,
INC. will not assume any responsibility or liability
for any repairs, rebuilding, welding, or heat
treating done to its materials, products or supplies
outside of D. M. BEST CO., INC. plants; such work
shall void any and all warranties.
C. Customer's sole
and only remedy in regard to any defective materials,
products or supplies shall be the repair or
replacement thereof as herein provided, and D. M.
BEST CO., INC. shall not be liable for any
consequential, special, incidental or punitive damage
resulting from or caused by any defective materials,
products or supplies.
A new warranty period shall not be
established for repaired or replaced materials, products
or supplies; such items shall remain under warranty only
for the remainder of the warranty period on the original
materials, products or supplies.
